| In January 2019,the Electronic Commerce Law of the People’s Republic of China was promulgated and implemented,and the implementation of this Law is of great legal significance to the development of the electronic commerce industry.In recent years,the Internet application technology has been developing continuously,and the e-commerce industry in China has also flourished,at the same time,there are some factors that hinder the development of e-commerce.E-commerce credit hype is one of them.Regulation of e-commerce credit hype behavior is of great importance to the good development of e-commerce industry in China.Because the e-commerce credit hype behavior belongs to the new thing,therefore the electronic commerce law does not carry on the related law stipulation to it,E-commerce credit hype behavior,urgent need to carry out laws and regulations on the constraints.The first chapter of the paper introduces the e-commerce credit hype behavior,and defines it conceptually,and then summarizes the characteristics of e-commerce credit hype,the elements and forms of expression,the necessity of legal regulation.The second chapter,combined with the case of judicial practice,concludes the actual situation of e-commerce credit hype and the problems of legal regulation.The third chapter analyzes the current situation of the regulation of e-commerce speculation by e-commerce law in foreign countries,compares the current system and judicial practice of our country,and analyzes its reference.Chapter IV Electricity in China The regulation of sub-commerce credit hype puts forward some perfect suggestions on legislation,through the legal characterization of e-commerce credit hype,the clear legal responsibility of the subject,the establishment of a perfect punishment system for breach of trust,etc.,to regulate the behavior of e-commerce credit hype,in order to improve the law in the field of e-commerce industry. |
