| The settlement of disputes in rural society is a hot topic in the field of law in China.At present,the rural society in China is undergoing political,economic,ideological and other changes.The rural society has changed from a traditional acquaintance society to a “semi acquaintance society”.At the same time,due to various reasons,the frequency of conflicts and disputes is increasing year by year,and the types are becoming more and more complicated.However,there is a lack of an effective dispute mediation mechanism in rural society,so conflicts continue to accumulate and deepen until they break out.This paper takes the rural transformation period as the social background,takes the village A in East China as the research object,analyzes the type and quantity changes of rural disputes,analyzes the predicament of the dispute mediation mechanism in village A,demonstrates the necessity of diversified development of the dispute resolution mechanism,so as to give full play to the advantages of all aspects and form a dispute mediation mechanism in line with the specific situation of rural society.The first part combs the theoretical part of the rural dispute mediation mechanism,and shows the evolution of the rural mediation mechanism in China.This part focuses on the macro issues.The second part is the empirical research on village A,which starts from the basic situation of village A,brings the research perspective into the scope of village A in east China,and analyzes the typification of disputes arising from village A,so as to have a basic understanding of village A.The third part further analyzes the difficulties in the operation of the mediation mechanism in village A,combines theory with practice,and focuses on the in-depth reasons for such difficulties,so as to better guide the improvement of the mediation mechanism in rural disputes.The last part is to elaborate the perfection and vision of the rural mediation mechanism.While integrating various aspects of the system,explore the possibility of the effective use of “local resources” in the rural mediation mechanism,in order to realize the benign construction of the dispute mediation mechanism. |
