Research Of Telecommunication Network Fraud Cases Characteristics And Control Countermeasures

In recent years,the telecommunication network frauds occurred frequently in China.The number of telecom network fraud cases raise from 2014 to 2017.The death case of Xu Yuyu happened in Shandong Linyi,has aroused public concern and has baneful influence.Telecom network fraud has seriously affected the basic life of citizens and it is necessary to fight the fraud.The research object of this paper is the first-instance written judgment of telecommunication network fraud cases made by courts of the whole country on “China Judgements Online”.Total 2496 first-instance written judgments from January 2015 to June2019 were obtained,by using crawler scripts of Python.Based on data mining method,8714 pieces of data of the defendant were extracted,and 17,631 pieces of legal provisions were cited from the first-instance written judgments.And related theme works were obtained by extracting the main text of the first-instance written judgments based on LDA theme model and optimizing parameters.Based on the descriptive and exploratory analysis of data in each stage,the characteristics of telecommunication network fraud cases are pictured as follows:The defendants of telecommunication network fraud are mostly male,and their cultural level is low,and most of the defendants are between 20 and 33 years old.Most telecommunication network fraud cases distributed in the southern and coastal areas.,and telecommunication network fraud cases show the characteristics of transregional crime、 cross-border crime and group crime.The group organization structures have changed from simple partnership to corporate operations,and pyramid selling structure has occurred.From analyzing the process of crime,industrialization was founded in the process of sending fraudulent SMS,illegally obtaining bank cards and illegally obtaining citizens’ personal information,etc.The fraud scripts were updated with the social focus.Based on the research,the following control suggestions are put forward.First,under the joint conference system,the public security organs should actively cooperate with Banks,operators,internet enterprises and other relevant entities to establish a multi-agent coordination mechanism while promoting the anti-fraud center.Second,under the continuous improvement of laws and regulations,the government,finance,communications,internet and other industries should strengthen the enforcement of laws and regulations,focusing on strengthening the real-name system management and personal information protection.Lastly,from the perspective of victim prevention,promotion channels should be increased to enrich the citizens’ knowledge of the telecommunication network fraud methods and prevention methods,and improve citizens’ precautions ability.
