The history of copyright is a history of expansion.With the continuous development of economic globalization and technology sharing,the phenomenon of copyright expansion shows two trends.One side advocates to continue to strengthen the protection of copyright to curb the current technology covert network piracy infringement;the other side opposes the unlimited expansion of copyright,which believes that unconditional expansion will infringe on the realization of social public interests.It is true that copyright from the date of its birth determines that it has both public and private law attributes,and every technological change will have an impact on the copyright system that balances the public and private domain.Each copyright expansion includes the policy direction and the interest choice at that time,the network copyright expansion works For a new round of copyright expansion of the representative,can not escape the cycle of history.The problem of copyright expansion is closely related to interests,technology and value choice at that time.Network copyright expansion not only follows the inherent logical development of copyright expansion,but also has a historical approach different from traditional copyright expansion.The current regulation of network copyright system is the criterion and cornerstone of describing the expansion of network copyright.From the internal and external perspective of network copyright to examine its expansion essence.From the internal perspective,it is found that the static system has a certain lag for the network copyright regulation,which leads to the current system norms for the network copyright protection and inadequate regulation,which leads to the expansion of the endogenous power;From the external perspective,it is found that it is dynamic Digital technology is constantly leading the development of network copyright,each iterative update of network technology will give birth to a new round of network copyright sample,resulting in the expansion of exogenous development.Network copyright in cyberspace presents a multi-angle,large-scale,deep-level expansion trend.The irrational phenomenon of this expansion makes the copyright system deviate from the inherent copyright value and idea of object legal principle,thought and expression dichotomy,originality.With the expansion of technology abuse,litigation abuse,monopoly and other issues,network copyright has evolved into the platform’s private interests to seize the tools and to escape the harbor,deeply infringed on the network social public interests represented by many network users.In the face of the network technology risks such as algorithm black box,algorithm discrimination and algorithm killing,the problem of network copyright expansion will be aggravated.Looking back on the history of copyright,this paper thinks that it is necessary to solve the dynamic and static imbalance of network copyright from the perspective of the whole network field governance.After drawing lessons from the experience of network copyright expansion outside the country,it is found that the problem of network copyright expansion requires multi-stakeholder(copyright owner,related person,network platform,network user)to cooperate with the system and technology,including the establishment of "both soft and hard" and "technology law fusion" network copyright expansion governance system to solve the problem of network copyright expansion In particular,we should pay attention to the technology,information,control as the dominant position of the network platform copyright literacy construction.Only in this way can we resolve the negative impact of network copyright expansion and create a safe,peaceful and shared network copyright governance environment.
