Grass-roots judges play a very important role in our country,especially after entering the social transition period,the people’s thinking of rule of law is strengthened,the number of litigation cases is surging,and the phenomenon of blowout appears.Building a professional team of grass-roots judges is very important to ensure the quality of cases.Basic courts play an important role in the court system,so it is very important for the effect of post system reform in the whole court system.The goal of the reform of the post system of the basic level judges includes: to allocate the proportion of the posts of the basic level judges reasonably,to give the basic court judges the status prudently,and to realize the construction of "regularization,specialization and professionalization" of the grass-roots judges.The value of the reform of the post system of grass-roots judges includes: it is helpful to promote the further development of judicial reform in the grass-roots courts,to enhance the trial strength of the grass-roots courts,and to promote the classified management of the staff of the grass-roots courts.The professionalization of judges is a complex process,which includes many contents,such as the selection system of judges,the admission system of post judges,the guarantee system and supervision system of post judges,and even related systems such as the assistant system of judges.As a systematic and complicated large-scale project,the reform of the post system of the basic-level judges has achieved some results at present,which has initially realized the elite of the trial front-line judges.The reasons for the problems in the reform of the post system of the basic-level judges include: first,the vast resources of our country and the differences in the number of population and the level of economic development in various regions.Second,the reform of the post system of judges requires that judges only pass the examination of the selection mechanism smoothly.Therefore,whether the selection criteria of post judges are scientific and reasonable has become the key factor to build a professional team of high-quality elite judges according to the needs of our judicial reality.Third,if a reform is to be carried out smoothly,it is necessary to let the specific groups associated with the reform see the corresponding reform dividend.The goal of post system reform is to train professional judges.Therefore,one of the reasons for the problems after this reform is that the professional security mechanism of grass-roots judges can not meet the needs of the current professional construction of judges.Fourth,after the reform of the post system,the judicial personnel of the court are divided into three categories: judges,judicial assistants and administrative personnel.The classification of the duties of these three categories of personnel and salary treatment need to be further determined.By combing the operating mechanism of the reform of the post system of grass-roots judges and reflecting on the causes of the problems,the main ways to improve the reform of the post system of grass-roots judges in the new era are as follows: first,Scientific and reasonable determination of the proportion of judges,the proportion of judges has a good premise and foundation.Second,it is reasonable to determine the entry standard of the post system of the grassroots judges.Only if the selection criteria of the post judges conform to the actual requirements of the grassroots,can the incoming judges better serve the grassroots.Third,it is necessary to strengthen the professional security mechanism of grass-roots judges grass-roots judges,enhance the sense of professional honor of grass-roots judges,further improve the evaluation mechanism,promotion mechanism and withdrawal mechanism of grass-roots judges,and encourage post judges to be willing to work as judges for life.Fourth,we should further strengthen the classified management of court personnel at the grass-roots level,allocate a suitable proportion of judges’ assistants and clerks,form a model of team division of labor and cooperation,promote the sound development of trial work,and realize the effective decentralization of judges,trial assistants and judicial administrative assistants.
