The Judge Post System Research

The judge post system is an important measure in the process of judicial reform at present stage,but in different pilot areas appeared different obstacles and potential problems.Through the analysis of theory,the summary of the pilot areas and the investigation to the outside,finally proposes some suggestions to the judge of the construction of the judge post system,in order to improve the judge post system mature at an early date.In this paper,a total of four chapters.The first chapter analyzes the related theory of judge post system.The judge post system is not fiction.Like other judicial reform measures,the judge post system also has deeply theoretical basis,it has its unique value pursuit and logic that shall be followed in the process of reform.Therefore,this article through to the related theory of number of judge and judge post system to carry on the detailed analysis,to found the deep reasons of the problems appeared in the process of the reform.Then find the right solutions.The second chapter analyzes the results of pilot areas,extract experience,analysis the problem.Starting from the judge professionalization,exploration and test is never stop,the former exploration laid a solid foundation for the judge post system.We should make the system a part of the judicial reform.so as to make more comprehensive analysis of the judge post system.The third chapter has carried on the investigation to outside.The judge post system is not used only in mainland China,common law and civil law countries (regions) have made a long period of exploration.There are a lot of content that we can learn from.The judge post system in our country at present stage have some urgent problems to solve.Such as how do you determine the proportion of the number of categories,how to selection the judge,how to manage the support personnel and so on.Aiming at these problems,the paper selected the typical countries and regions to study,so we can learn their experience.Its fourth chapter,some suggestions are put forward,on the basis of theoretical analysis,pilot experience and comparative study.I hope the suggestions can find a way while the reform is so hard.
