Research On The Licensing System Of Copyright In Online Literature

Chinese online literature in the 21st century has absorbed the essence of Chinese culture and combined with the rapid spread of Internet technology,which has had a profound cultural impact in the world.In the copyright licensing trade of contemporary online literary works,large-scale digital online transactions will become the mainstream form.Trade parties sum up practical experience,self-development of electronic copyright licensing format contracts,greatly reduce transaction costs,in line with the needs of high-volume high-speed transactions.However,most of these forms of contracts for the platform side to make a separate,part of the content of the provisions walk on the edge of the law,a few provisions violate the spirit of fair and just civil law,causing a lot of litigation disputes.In addition,China’s copyright collective management organizations are slow to respond to the market changes in online literature,lack of competition in operation,opaque internal management,and urgently need reform.Because of the particularity of the dissemination carrier of online literary works,this paper finds two paths for perfecting the copyright licensing system of network literature in China after analyzing and comparing various mainstream copyright licensing types at home and abroad--the official guidance of the format contract sample and the extended copyright centralized licensing system.
