| Police power is the product of the differentiation of national public power.If the police power is used properly,it can become a powerful weapon to maintain social order,combat crimes and protect human rights.If the police power is abused,it will be alienated as a weapon that infringes the individual rights of citizens and is above the law.Only under the rule of law and the continuous expansion of public power can the police maintain its benign operation.The abuse of police power is not uncommon.The essential reason is that the system construction of standardizing and controlling police power is not in place,and there is no linkage between internal supervision and external supervision mechanism.The police power without institutional constraints will compress civil rights and destroy the balance between state public power.This paper attempts to analyze the shortcomings in the regulation and control of police power.By learning from the beneficial experience of extraterritorial countries（regions）,this paper makes up for the deficiencies in the system construction of our country,discusses the internal and external regulation and control methods of police power,and solves the problem of police power anomie.In the process of studying the regulation and control of police power,we need to recognize the following aspects: first,to clarify the connotation and characteristics of police power is the premise of carrying out the research on the regulation and control of police power.We should distinguish whether police power is an administrative power or a judicial power in essence,and the restriction methods of different kinds of power are different,so as to lay a foundation for the follow-up research Basics.Second,we should make it clear that the regulation and control of police power can be carried out from the internal and external levels.Only by improving the internal and external system construction,can we really control the powerful public power of police power.Third,we should realize that the research on the regulation and control of police power needs to be based on practice,which means that we should fully consider the problems existing in the regulation and control of police power in our country at the present stage,extensively study the excellent experience of different countries and regions abroad,and fully consider the excellent experience of rule of law construction abroad and the management system and judicial system of our country The matching degree makes the research results feasible and can be used in the practice of rule of law.In addition to the introduction and conclusion,the text is mainly divided into four parts.The first part mainly introduces the connotation and characteristics of police power,including the connection of police power and related concepts.The second part mainly expounds the problems existing in the regulation and control of police power.In terms of internal regulation and control,it mainly includes three situations: the police force staffing needs to be improved,the internal law enforcement norms of police power are not perfect,and the current internal supervision mechanism of police power has not formed a joint force;in terms of external regulation and control,it includes the legislative regulation of police power is not perfect,and the judicial supervision of police power There are three aspects: the limitation of supervision and the low effect of social supervision of police power.The third part mainly refers to the practice of overseas police power regulation,discusses the methods of "no system" supervision system in the United States,Independent Police Complaints Commission in the United Kingdom,pre-trial judge system in France and internal police supervision system in Hong Kong,and summarizes the experience of overseas police power.Finally,the fourth part is mainly based on the Enlightenment of extraterritorial countries（regions）,and obtains the legal methods and practical countermeasures to adapt to the internal and external norms and control of China’s police power. |
