| In recent years,defense lawyer’s rights have been violated frequently,and caused hot discussion in the society.If this phenomenon is allowed to develop,it will not be conducive to the healthy development of the team of lawyers.At the same time,it will also affect the image of the judicial department of our country.In addition,lawyers as agents to safeguard the legitimate rights and interests of the parties,if their rights are infringed,it will inevitably affect the defense effect,and will also produce some deviation from the protection of human rights which advocated by our country,and may also lead to misjudgments.The Ministry of justice published the latest data such as lawyers and notaries on its official website in 2018.The data showed that by the end of 2017,there were 28,000 law firms in China and there were 365,000 practicing lawyers in China,compared with the last year,the number of lawyers in our country has increased by 11.5%.So we should safeguard the development of this profession and protect the legal rights of lawyers.Therefore,in order to solve the above problems better,this paper takes the arson case of Hangzhou nanny as an example,according to the problems of lawyers’ withdrawal from court and subsequent assignment of defense lawyers in this case,analyzes the shortcomings existing in the protection of lawyers’ defense rights in China at present,and puts forward corresponding suggestions to improve the protection of lawyers’ rights in China,so as to promote the smooth development of the whole judicial activity.This article is divided into three parts.The first part is the background and significance of this paper,and makes a simple exposition of the current research on lawyers’ rights protection at home and abroad.The second part is the main body of this article,which mainly introduces the basic case of the arson case of Hangzhou nanny and the protection of lawyers’ rights in pretrial and trial stages.The third part is the conclusion of this article.The author believes that with the continuous improvement of China’s laws,lawyers’ rights can be effectively guaranteed in practice.So as to promoting the effective exercise of lawyers’ defense rights,thus safeguarding the legitimate rights and interests of the defendants and promoting fairness in the administration of justice. |
