Gene editing is destined to be a subversive revolution in science and technology,bringing huge health dividends to human beings,as well as a series of sensitive and thorny social,ethical and legal issues.The boundary of rational use of gene editing and the design of legal level need to be clearly guided by law.Different from the general medical clinical trials,the upper limit of harm lies in the individual’s right to life.Heritable gene editing is the common fate of all human beings.Because of the high risk,it is important for the public interest.It is urgent to manage the research and application of gene editing technology from public law.Gene editing itself is a technical system with rich types.Different types of gene editing have different effects on individual legal interests,and it also puts forward higher requirements for legislation.At present,human gene editing is involved in China’s public law system,but there are large gaps in the scope of regulation and many loopholes in mechanism design.The high risk of gene editing technology development and the absence of relevant laws and regulations reflect the urgent need to study and perfect the public law regulation on gene editing.The first part of this paper demonstrates the legitimacy of the public law regulation of gene editing,and analyzes the particularity of the regulation.The second part sorts out and summarizes the existing public law norms related to gene editing.In the third part,the author analyzes the problems of public law regulation of gene editing in our country by combing the legal text,domestic legal practice and foreign experience.The fourth part,according to the conclusion of the previous study,combined with the particularity of gene editing public law regulation,put forward some suggestions for improvement.
