Dilemma And Breakthrough In The Recognition Of Tort Liability Of Civil UAV With Privacy Right

In recent years,with the development of UAV technology,UAV is not the exclusive appliance of military or police departments,UAV is developing towards a lighter and smaller trend,which meets the entertainment needs of contemporary young people and becomes the darling of flight enthusiasts.While enriching the life and entertainment needs of citizens,it brings more and more issues of privacy infringement,which is concerned by the society.Compared with the general privacy infringement,the civilian UAV is more covert,the unique man-machine separation control mode often makes people can not find the "real culprit behind the scenes ",and the data space connected to the Internet at the other end of the UAV is unimaginable if the collected privacy information is sent to the Internet and used by Internet users.But excessive intervention in the flight of civilian drones will also affect the free flight rights of UAV owners and the vitality of the UAV market.Therefore,in order to better maintain the privacy rights infringed by civilian drones and protect the development of UAV market,this paper analyzes the current civil UAV privacy infringement problem,hoping to explore a better way.This paper mainly studies the dilemma of civil UAV privacy tort liability,and gives a breakthrough path.The first part introduces the background of civilian UAV development and the cases of civil UAV privacy infringement in China,and analyzes the significance of studying this kind of content.The second part introduces the concept of civilian UAV,and classifies the concept of light and small civilian UAV by use,flight purpose and quality.This paper also introduces the concept of privacy,and analyzes the behavior of light and small civilian UAV ‘s violating privacy.In the third part,according to the particularity of privacy infringement of light and small civilian UAV,the dilemma of responsibility determination is studied.The fourth part provides enlightenment to the regulation of light and small civilian UAV in China.The fourth part is to perfect the legislative suggestion,clarify the subject of responsibility,summarize the principle of imputation,and put forward the breakthrough path of exemption from responsibility.
