| Webcast sales is a cross domain combination of webcast and e-commerce.It has become one of the most popular shopping methods because of its immediacy,interactivity and strong sense of scene.Especially after the epidemic,the network live broadcast sales become a new economic growth point.But at the same time of its rapid development,it also gradually exposed a variety of problems,such as vulgar live content,no guarantee of product quality,data fraud and so on.These problems damage the legitimate rights and interests of consumers and destroy the market order.In this regard,the relevant government departments have begun to strengthen the supervision of online live broadcast sales by formulating relevant regulations and normative documents,carrying out special rectification activities and so on.However,due to the new mode of online live broadcast sales,many subjects and complex legal relations,there are many problems in the supervision.Problems such as imperfect regulatory basis,overlapping regulatory powers,unclear legal nature of regulatory objects and imperfect regulatory measures need to be solved.Based on the problems existing in the legal supervision of online live broadcasting sales,this paper analyzes the experience of legal supervision of online live broadcasting sales in Zhejiang,Beijing and other regions,and draws some useful experiences,such as improving the market access mechanism of anchor,improving the dispute resolution mechanism,playing the role of industry associations,and promoting social co governance.Combined with the problems existing in the supervision,this paper puts forward some suggestions on improving the legal system of the supervision of live broadcast sales in China from the four aspects of supervision basis,authority,object and measures.This paper elaborates from four chapters: the first chapter is "overview of webcast sales".This chapter introduces the concept and characteristics of webcast sales,as well as the relationship between the participants in webcast sales,and analyzes the problems existing in the rapid development of webcast sales in China.The second chapter "the current situation of China’s online live broadcast sales supervision and the problems existing in the legal system",mainly analyzes the problems existing in the supervision process from the four aspects of the supervision basis,the supervision subject,the supervision object and the supervision measures.The third chapter is "advanced experience and Enlightenment of local supervision of domestic webcast sales".This chapter lists the advanced experience of Zhejiang and Beijing in the supervision of webcast sales,and summarizes the Enlightenment of advanced experience of local supervision of domestic webcast sales after analyzing them.The fourth chapter is "suggestions on improving the legal system of live broadcast sales supervision in China".This chapter combines the advanced experience of live broadcast sales supervision in some areas of China,and in view of the problems raised in the second chapter,from the basis of improving supervision,reasonably dividing the supervision authority,clearly defining the legal nature of the supervision object,establishing the legal system of the supervision system of live broadcast sales Improve the regulatory measures in these four areas to improve the countermeasures and suggestions. |
