Research On Social Insurance Rights And Interests Of Internet Platform Practitioners

The economic achievements of the Internet have brought new development opportunities to China.In particular,during the COVID-19 outbreak,Internet economy is of great significance to people’s lives.During the rapid progress of the Internet,the group of Internet platform practitioners is also growing,but the current Social Insurance Law of China does not include Internet platform practitioners in the scope of social insurance for employees.Since there is a certain binding relationship between social insurance and labor relations in China,employees of Internet platforms cannot be included in the social insurance system under the premise that the labor relationship between employees of Internet platforms and employees of Internet platforms is not clear yet,which makes them face greater occupational risks.Although the Internet platform employees mainly adopt flexible employment forms and work in diversified ways,their pursuit of social insurance rights and interests is no different from that of employees.Against the background of the continuous expansion of the employees of Internet platforms,The social insurance rights and interests of these workers are closely related to the steady development of China’s economy.Based on this,this paper adopts literature analysis method,social research method,comparative analysis method and other research methods to discuss the social insurance rights and interests of network platform practitioners,an emerging profession.In this paper,according to the existing platform of Internet social insurance related theory,starting from personnel of course of study,and then based on the platform of the Internet professionals do conceptual definition and distinguish,consider the relationship between them and the Internet platform for further classification,and points out that this paper studies the main body is labor relationship between the Internet and Internet platforms from personnel of course of social insurance problems.According to the above concepts,the characteristics of Internet platform practitioners are analyzed and summarized.Second,through the Internet platform city workers,a sample of social investigation,the survey by the Internet platform workers,the basic information of the situation and situation of the labor contract,social insurance,etc is analyzed,and concluded that the main problem of platform from personnel of course of social insurance is: the proportion of employees of Internet platform participating in social security is in a low state,they have a very strong desire to participate in insurance,from personnel of course of general lack of formal labor relations and the low degree of understanding of the trade union and participation.Then,according to the income problem,the causes of its analysis.At present,in China,the reason why the problem of Internet platform worker’s right related social insurance is caused exists following possible : the theoretical bundle between platform and workers and practice of hidden employment and fuzzy barriers to employment coexist,the Internet platform from personnel of course of how to pay the social insurance system problem,the Internet platform from personnel of course of the current social insurance for the staff and workers of ginseng incentive is not enough,the Internet platform practitioners social forces is weak wait for a reason.Finally,on the basis of drawing lessons from the social insurance-related legislative experience of extraterritorial Internet platform practitioners,the author puts forward the path to solve the social insurance-related problems of Internet platform practitioners.China needs to innovate the theory of decoupling social insurance and labor relations,correctly divide platform practitioners in legislation and judicature,flexibly construct insurance conditions and payment methods suitable for platform practitioners,and improve the labor union’s ability to protect the practitioners of the Internet platform,and put their protection into effect.
