| As a social norm system,law is formulated or recognized by the state and implemented with the national own force(compulsory institution),which plays a crucial role in regulating public relations,alleviating social contradictions and coordinating social development.With the continuous development of China’s comprehensive strength,the relationship between social members is more and more close,and the cooperation and friction in economic and social fields are more frequent.Therefore,the public legal service industry has begun to rise.As for the meaning of "public legal services",the term "public" can be understood as "public relations",which was originally originated in the United States of America in1882.At that time,Durman Eaton,an outstanding representative of the great law circle,interpreted the meaning of the term as "public relations" in his graduation speech to Yale University Graduates in New Haven City,Southern Connecticut The "public interest" is characterized by "universality of objects".The purpose of so-called "public legal service" is to make the masses of society get basic legal service guarantee through the participation of the government,and thus alleviate the uneven allocation of legal resources among different regions.This paper holds that "public legal service" as an effective means to adjust the distribution of legal resources must form a perfect and full structural system,which is more conducive to the maintenance of the basic legal rights of the public,reducing legal risks,resolving social contradictions,promoting social justice and improving the credibility of law.As far as the current situation of China is concerned,although most areas have already carried out the practice and exploration of "public legal service",at the same time,public legal service also faces some typical problems such as lack of system guarantee,insufficient talent reserve,serious aging mechanism,lack of resources and funds,lack of awareness of legal services of the masses.These problems not only seriously hinder the public from enjoying good legal services,but also increase the possibility of public facing legal risks,which is not conducive to resolving conflicts,but also easy to cause accumulation of social contradictions.At present,there are many problems in the process of perfecting the construction of public legal service system in some areas of China,especially in the district and county areas.Due to the imperfect legal services facilities,it is difficult to carry out the corresponding public legal services in an orderly manner and there is a risk of lameness.Therefore,based on the previous research and data collection,this paper,based on the theoretical logic,takes the practice experience of the county public legal service system construction in Donghu District of Nanchang as an example,and combines the domestic research data in relevant fields,and divides the system construction of "public legal service" into six parts,which are "institutional team system","regulatory system","product system","market system" System,platform system and feedback system.Combined with the above six systems and the actual situation of Donghu District of Nanchang,the paper discusses the practical risks and causes of the construction of the county public legal service system.Finally,it summarizes and analyzes the above problems and causes under the guidance of the four basic principles of rule of law,standardization,innovation and normalization,and then summarizes and analyzes the above problems and causes The optimization approach of the construction of the common legal service system is expected to give full play to the promotion of the construction of the public legal service system on the county governance ability and governance level,and also plays a reference role in the construction of the public legal service system in each county and district. |
