Research On The "Umbrella" Of Underworld And Evil Forces And Its Countermeasures

As a kind of social cancer,the underworld and evil forces have been plaguing countries all over the world.These gang members disrupt the economic order and destroy the social stability,which have had a huge negative impact on the country and the people.In China,one important reason why these illegal forces have been able toraise winds and waves for a long time is that they have been protected by the “umbrella” that who has opportunities to exercise public power,some of them come from the Public Security Troops.There are many factors that cause the existence of the “umbrella” phenomenon of the underworld and evil forces in the Public Security Troops,involving subjective and objective aspects,but there is no doubt that this is a kind of criminal actions,should be severely punished by the law.As early as 2000,China launched a massive special campaign against underworld and evil,and set up a national leading group for this campaign.In 2006,the Central Government of China set up the nationwide“Anti-crime Office”,and set up a special task force to coordinate the fight against crime and evil.In January 2018,after more than a decade,the special campaign to crackdown crime was officially upgraded to the special campaign to sweep away crime due to the release of the Notice on Carrying out the Special Campaign of Sweeping away Underworld and Evil.Today’s underworld organizations ostensibly take“legalization” as the cover.For “crackdown”,“sweep” can accomplish tasks more deeply and resolutely,which is enough to show that the party and the nation attach great importance to thoroughly eliminating the underworld and evil forces.Digging deep and severely cracking down on the “umbrella” behind the forces of gangs is an important measure to ensure that crime organizations would be eliminated.Therefore,at the same time,the “Crack down on umbrella”action is also carried out in full swing,and a series of obvious results have been achieved.For our nation,it is an important and long-term work to fight “umbrella”of underworld and evil forces,at the same time to prevent it from forming.This article consists of 4 parts.The first part is an overview of the “umbrella”of the underworld and evil forces,including the meaning of the word “umbrella”,its definition,the characteristics of the “umbrella” of the underworld and evil forces in the Public Security Troops,mainly clarifying the question of what is the“umbrella ”of the underworld and evil forces and who is the “umbrella”of the underworld and evil forces.The second part is about the manifestation types and social hazards of the “umbrella” in the Public Security Troops.There are many ways to classify the manifestation types.This paper mainly adopts 15 types of classification methods,among which 5 types mainly involve the Public Security Organs,namely: Investing and receive dividends,harbour criminals,divulge secret information,obstructing the investigation of cases,disculpation,and given the corresponding cases,to show that the “umbrella” harms the interests of the nation,contrary to the core socialist values,smears image of police,destroys the result of “sweep away crime” work.The third part is the reasons for the formation of this “umbrella” in the Public Security Troops.This paper believes that there are mainly 4 reasons,such as personal psychological imbalance,too frequently to face the cases of underworld and evil forces,as the people’s police lack of sense of honor,supervision of public power is inadequate,and analyze them one by one.The fourth part is about the countermeasures against the “umbrella” of the underworld and evil forces in the Public Security Troops.Firstly,to improve party discipline,use the model to take the lead to restrain the behavior of the party members in the Public Security Troops,which can reduce the occurrence of unhealthy tendencies from the source.Second,to modify the Administrative Penalties Law,the punishment should not be limited to the units and departments that make wrong administrative decisions,but the specific reasons behind the punishment should be further explored and the punishment measures should be implemented to individuals.Thirdly,to implement the Public Official Punishment Law,it should be closely integrated with the Supervision Law,so as to put an end to the practice of directly punishing public officials indiscriminately for the purpose of “maintaining stability” or “pour oil on troubled waters”,so that police officers will have more confidence in performing their duties according to law.Fourthly,in the aspect of Criminal Law,the crime of punishing evil forces and their “umbrella” should be established,and the members of the Public Security Troops who participate in and organize criminal gangs should be severely punished,develop procedures specifically for handling these cases,so as to create sufficient deterrent force for them.Fifth,in terms of the Supervision Law,it is necessary to strengthen law-abiding education,improve the protection measures for prosecutors,and make clear the standard of fighting against the“umbrella” of underworld and evil forces,so as to enhance the efficiency and accuracy of the supervision organs’ work in combating the “umbrella” of underworld and evil forces through these forms.Sixth,in terms of the People’s Police Law,provisions should be made to clarify the scope of police duties,strengthen the management of auxiliary police officers,and attach importance to the mental health of police officers,so as to make the law more close to the actual situation of the police force.Finally,I would like to conclude with a series of important achievements.We have every reason to believe that this campaign will eventually achieve overall success.
