| During COVID-19(hereinafter referred to as "COVID-19")epidemic,the state took prevention and control measures such as reducing the gathering of people,requiring enterprises to suspend production and isolating patients for treatment.These prevention and control measures objectively affected all aspects of labor relations to a certain extent.It is necessary for the state to make timely adjustments to the labor relations that do not adapt to public health emergencies.Later,China introduced relevant labor policies to adjust labor relations.These policies played a positive role in stabilizing labor relations,but there were also some legal problems.For example,the relevant provisions of the adjustment policies broke through the original labor legal system and added more obligations to the employers.How to adjust labor relations in the face of public health emergencies such as the outbreak of "COVID-19" has become a hot topic of social concern.This paper discusses the adjustment of labor relations under public health emergencies from three parts.The first part,mainly through the analysis of the connotation and adjustment of labor relations,the adjustment of labor relations under the emergency of public health events.The second part points out the problems existing in the adjustment of labor relations in China under the epidemic situation by analyzing the force majeure in the compulsory performance of labor contracts,the burden of wages during the epidemic period and the identification of industrial injuries caused by labor injuries.In the third part,combining with the reality of China,it is proposed that the adjustment of labor relations should follow the principle of rule of law and fairness under the public health emergencies such as "COVID-19" epidemic,and the execution of labor contracts should construct the suspension system of labor contracts,and the implementation of labor contracts should adopt diversified ways.As for the burden of labor and wages,we should reasonably share the risk of wage payment during the shutdown period,attach importance to the collective consultation system,and perfect the burden mechanism of labor and wages under public health emergencies.As for the identification of work-related injuries,we should transform the temporary administrative policy into a long-term mechanism,broadly define the scope of identification of work-related injuries in major epidemics,and improve the industrial injury insurance system under public health emergencies.Thus,the labor relations adjustment mechanism under public health emergencies is constructed to stabilize the labor relations and prepare for the future crisis. |
