The Study On The Selection Of People’s Assessor In China

In the past,there are few papers focusing on the selection system of jurors,and the time of papers is relatively early.Therefore,in view of the new situation of judicial reform,considering the people assessor system and relevant judicial interpretations and methods,this paper makes an on-the-spot investigation of G City,S Province,and mainly studies the selection system of people’s assessor in China through questionnaire and in-depth interviews.This paper discusses the actual operation effect of the current election system in the grass-roots people’s court,and the new problems in the selection in recent years.At the same time,this paper puts forward problem-based feasible countermeasures and suggestions,in order to let the public really understand the judicial system,and play the maximum value of people’s assessor system.In addition to the introduction and conclusion,this paper is divided into four parts.The first part: This section takes the development process of the people’s assessor selection system in China as the breakthrough point,and describes the origin,development and current situation of the jury selection system.By in-depth analysis,this paper summarizes the characteristics and drawbacks of jury selection system at each stage.The second part: This section makes a deep investigation about the current situation of the system of selecting people’s assessor.Firstly,this paper takes City G as an example in chart analysis and selects County W as research sample.In addition,through the combination of data analysis and questionnaire method,this paper objectively explains the implementation status of the local juror system and the system problem.The third part: Combining interviews with the local judge,the administrative staff in justice bureau and the juror,this section specifically lists and comprehensively analyzes the existing problems of the people’s jury system in County W.With the deep analysis on the juror system problem,this paper discovers many problems,including lack of width and depth of publicity before the selection of jurors,the unreasonable proportion of selection,the unsmooth linking between withdrawal and supplement mechanism,and lack of communication and coordination among different departments.In addition,it also discusses the problems of other supporting systems of jurors,such as the unscientific and unreasonable selection of jurors by the court,and the serious shortage of jurors’ subsidies.The fourth part: on the basis of the previous empirical analysis,this paper puts forward the following suggestions to solve the above problems and improve the jury selection system,mainly including increasing the publicity of the jury system,redefining the proportion of different selection methods,establishing the leave and withdrawal system of jurors,clearing the responsibilities of various departments.It also puts forward some suggestions on other supporting systems,for example,building the unified electronic system of the court,and drawing up the implementation methods of subsidies quickly.
