Research On The People’s Character In The Construction Of Smart Court

Informatization has brought a once-in-a-lifetime opportunity for the construction of the rule of law in China,and local courts quickly introduced artificial intelligence to carry out informatization reforms.In 2016,the state formally proposed the construction of smart courts,insisting on achieving fairness and justice as the goal,and rationally promoting the wisdom of the people’s courts in litigation services,trial execution and other judicial activities,so that the people have more sense of gain in the development of informatization.This article mainly focuses on how the people’s character is reflected in the construction of smart courts and how to better implement this judicial reform phenomenon.Expand the discussion according to the following four parts.The first part discusses the development thread and connotation of Xi Jinping’s rule of law thoughts.The theory of people’s nature can be traced back to Mao Zedong Thought,in which the mass line is the soul of people’s nature.The construction of the rule of law in our country has embodied the values of the people from the name of the people’s court and the systems of people’s mediation and people’s jury in the base area.The formation of Xi Jinping’s thought on the rule of law is also inseparable from the guidance of the above-mentioned theory and practice,putting the people in the first place,relying on the people’s power to achieve the people’s well-being,and embarking on a road of upholding the rule of law that adheres to the people’s nature under the leadership of the party.The second part discusses that the value of the people is the inherent requirement of the construction of a smart court.The construction of smart courts requires that we adhere to the work position of serving the people,focus on solving the basic demands of the people,and fulfill their duties to protect the legitimate rights and interests of the people.The internal construction of smart courts through the realization of scientific management,in order to improve the fairness of judicial behavior,continuously improve the information system and management mechanism,continuously improve the level of clean justice,and realize the value of the people as a judicial organ.The third part discusses the grasp and test of people’s character in the construction of smart court.The construction of smart courts always adheres to the principle of justice for the people,and firmly grasps the people’s character in trials,enforcement,and supervision.However,there are still situations in the construction of smart courts that deviate from the value of people’s nature.The black box of algorithms affects people’s right to know.People’s ignorance of information technology increases their own litigation costs.The excessive reliance of judges also violates the original intention of smart courts.The problem of inadequate collection and protection of people’s information is also not conducive to the construction of smart courts.The fourth part discusses the theoretical persistence and system perfection of the people’s character in the construction of smart courts.The construction of smart courts should be based on adhering to the leadership of the party and implementing the people’s concept of the rule of law.Improve algorithm regulation,formulate reasonable data search and use rules,and reduce the damage to the fairness of judicial judgments due to human prejudice and errors.Judges can better improve their work efficiency through the auxiliary work of artificial intelligence.People can use construction results to reduce litigation costs,increase people’s recognition of smart courts,and meet the people’s needs for fairness and justice.
