This article first sorts out the current status of copyright protection for video game rules.There are serious "plastering" plagiarism in video game and decentralized copyright protection is difficult to cover the rules of video games.Then this article analyzes the copyrightability of the video game rules,points out that the video game rules as an atypical copyright protection object also has the rationality and feasibility of copyright protection;at the same time,this article analyzes the boundary of ideas and expressions,and puts forward the idea of abstracting the rules of video games through the method of abstraction-filtering-contrast.In Chapter 3,this artile analyzes the originality of video game rules According to the closeness of the rules of video games and reality,rules are divided into three categories: video game rules that fully simulate reality,video game rules based on existing materials,and completely fictional video game rules.Simulated reality video game rules also have the possibility of originality.When discussing the originality of completely fictitious video game rules,we must also specifically analyze whether they meet the minimum level of originality requirements..Finally,on the basis of the previous analysis,Chapter 4 focus on the analysis of the substantive similarity of video game rules.In terms of identification standards,different levels of originality standards correspond to different types of video game rules,and the player’s feelings should be introduced as the subject standard for substantially similar identification.The overall comparison method can ultimately make the results of the identification more sensible. |
