The term "new form of employment" was first put forward at the Fifth Plenary Session of the 18 th CPC Central Committee.In recent years,the new employment pattern has become one of the new engines of China’s economic growth,driving the emergence of multiple new forms of flexible employment.Meanwhile,with continuous expansion of new types of flexible employment groups,such as online car-hailing drivers,takeaway food delivery workers,express delivery service employee,and network anchors,the revolution on existing employment structure in China has been accelerated.These new forms of employment,while creating jobs and achieving the goal of employment rate,are also bringing great challenges to the design and implementation of China’s labor security policies and laws,the standardization of labor market and the implementation of government supervision and management responsibilities.Based on the above background,the first part of this study analyzes the characteristics of the new flexible employment form in the perspectives of job opportunities,working hours,payment methods of labor remuneration and the provision of production tools,and compares these with the traditional employment form.Furthermore,with large number of literature review,and field investigation on employees under the new form of employment,the second part of this paper analyzes the existing problems within the protection of the rights and interests of flexible employees under the new form of employment.At present,a few labor rights of this group,such as the right to rest,employment equality,and job safety and health,are easily violated.Therefore,the third part of this paper analyzes the possible causes of the difficulties in the protection of labor rights and interests of the flexible employment personnel in the new form of business from three aspects: the weakening of affiliation between flexible employees and company,the non-standardized employment environment,and the difficulty in defensing their rights and interests.In the final part of this paper,some suggestions are proposed to improve the protection of the rights and interests of the employment groups in the new form of employment from three aspects:liberal identification for affiliation of labor relations,balancing the rights and responsibilities between employers and employees,smoothing the path for defense of the rights and relievers,and with these advice,legitimate rights and interests of the flexible employment groups in the new form of industry can be protected through multiple ways.
