The fourth industrial revolution,supply-side reform,sharing economy and mass innovation,the background and policy orientation have promoted the growing number of new flexible employment groups in China.The problem of workers' compensation for the flexible employment group is not compatible with the harmonious labor relations law governance environment.Due to the current labor contract law and inductrial injury insurance regulations stereotypes,a large number of flexible employment groups are not applicable to the law of industrial injury protection.This paper discusses the difficult problem of flexible employment injury protection under harmonious labor relations.Through index design,jurisprudence analysis,international comparison and other research methods,the classification of legal subjects in flexible employment groups is carried out,the situation of specific inductrial injury is analyzed.The research summarizes five legal norms to solve this problem,in this paper,we propose a method to establish flexible inductrial injury protection legislation according to the classification of self-employment flexible workers and employed flexible workers.In order to replace labor relationship identification and separate occupational injury insurance system for self-employed flexible workers;For other-employed flexible employment,expanding explanation of labor relations,with reference to the Japanese experience with the labor contract relationship(non-standard labor relations,the facts of labor relations,service relations)substitute for industrial injury of personnel relations;And gradually transition to realize industrial injury guarantee socialization.
