Research On The System Of Filing And Examining Administrative Standard Documents

As an abstract administrative act,administrative normative documents are more flexible and efficient than laws,regulations and rules,They are an important basis for administrative organs to engage in administrative management activities,and they are often used as the legal basis for specific administrative acts.However,my country’s administrative normative documents are still inadequate in the supervision mechanism,causing frequent occurrence of problems such as "red-head chaos",resulting in the loss of administrative power restraint,and also damaging the good image of the government.The main function of the administrative normative document filing review system is to regulate administrative normative documents.The system is divided into two forms: the NPC system filing review and the administrative system filing review.This article selects the latter as the research object.The filing and review system of the administrative system has the advantages of strong pertinence and high efficiency,In addition,the system still has some shortcomings that need to be improved,so it has very important research value.This article mainly investigates the implementation status of the administrative regulatory document filing and review system,analyzes some of the current problems in the system,and proposes feasible countermeasures to the problems.The article is composed of three parts:introduction,body(three parts),and conclusion.The content of the body is as follows: The first part explains the basic concepts of the administrative normative document filing and review system,including defining administrative normative documents and administrative normative documents The meaning of the filing review system,introducing the content of the current system structure,such as the subject,standard,start-up time and review method of the filing review,as well as the existing system advantages.The second part is to analyze the current development status of the system and the existing problems,This section takes the relevant regulations on the filing and review of administrative normative documents at the national and local levels as the entry point,sorts out the current development of the system,and examines the implementation effects of other administrative normative document supervision methods from the side The effectiveness of the supervision of the filing and review system of administrative normative documents,Then analyze the problems of the system on the basis of the development status,mainly: the scope of submission needs to be further clarified,the review process is not detailed,the review standards are different,the accountability system is incomplete,and the connection with the National People’s Congress filing review is not smooth.The third part is suggestions for improving the filing and review of administrative normative documents,Based on the above issues,the countermeasures are proposed one by one,including the following aspects:formulating unified laws and regulations,clarifying the scope of filing and reviewing,improving the filing and reviewing process mechanism,clarifying filing and reviewing standards,improving the accountability system,and strengthening the filing and review system with the National People’s Congress Linkage.
