| Just as Ericson has said that “what’s happening in a remote corner of the world could explain the central problem of social organization”.Mongolian creates the civil legal habits with unique personality suitable for nomadic production and lifestyle in thousand years of nomadic life in the northern grassland.The expression and practice of civil legal culture in nomadic culture in the legal text is greatly different from that of the civil law system developed in the agricultural civilization.Under the moving nomadic economic form,the Mongolian has a strong concept of chattel property rights.The paper makes the Mongolian nomadic brand culture generated in the nomadic economy as a case to reveal that the legal function of the brand with nomadic characteristics in the Mongolian possession of property and change of property right.The traditional brand culture has been evolved from the simple livestock production technology to be an important legal system closely related to livestock ownership system,livestock usufruct system and livestock trading system.As a traditional law of ethnic group,the role of the customary law of ethnic minorities in solving traditional problems of the ethnic group is significant and obvious,so the paper tries to interpret the Mongolian nomadic brand culture from a legal perspective,and it would display some problems reflected in the case.The paper is composed of three contents.Firstly,it is illustrated with the development and existence shape of Mongolian nomadic brand culture in the traditional nomadic society by law and anthropology with the background of Mongolian traditional nomadic culture.Secondly,there is a key illustration of the classification and taboo of Mongolian nomadic brand pattern,so as to show the inner charm of nomadic brand culture.Thirdly,there is a description of the change direction of the Mongolian nomadic livestock branding system and all kinds of problems when the legal function is employed;in addition,it would propose some solutions based on it. |
