A Study On Registration Effect Of Alteration In Ship's Ownership

Alteration of ship's ownership is often involved in ship business,owing to this; the registration effect in alteration of ship's ownership is raised to the public.What's more,it has become a vexed question in theoretic circle.Based on the comparison study on the two modes between antagonism and going into effect after registered,the author expounds the advantages of antagonism.Flowingly,the author puts forward some relevant advice after the analysis on the legal effects of registration stipulated in real right law and maritime law.And besides,this paper is divided into four chapters:The first chapter is about the basic theory on the legal effects of registration in the alteration of ship's ownership.It consists of two parts.Firstly the author introduces the definition of alteration in ship's ownership and its relationship with the legal effects of registration.Then the author introduces the definition of legal effects of registration and some facts that dominate registration effects.The second chapter is about legislation analysis on legal effects of registration in alteration of ship's ownership.It main discusses two parts.One is the relevant stipulation in maritime law;the other is the stipulation in real right law.And then the author demonstrates the application scope of the legal effects of registration in alteration of ship's ownership between the two laws mentioned above.The third chapter mentions specific analysis on the legal effects of registration, which is mainly about the effects of public summons.Besides,this paper emphasizes more analysis on the efficacy of public confidence of registry.The fourth chapter analyses the advantages and disadvantages of the legal effects of registration in alteration of ship's ownership.Based on the relevant stipulation about legal effects of registration in maritime law and real right law,this paper puts forward some suggestions on the amendments of maritime law.
