Humans and other animals are both important factors in the natural world,and have been closely related to each other for a long time of common development.However,with the advancement of human beings and the expansion of the living environment,animals are in a precarious situation.At the same time,human beings cruelly treat and kill animals in order to satisfy their own economic interests and appetite,which runs counter to the general trend of world civilization.At present,some developed countries have formed a fairly mature legal system that focuses on animal welfare.Their legislation provides effective and comprehensive protection for all kinds of animals,and highlights the willingness to live in harmony between humans and animals and their humanitarian care for animals.In contrast,our country is in a state of absence in this regard,and the cruelty to animals cannot be effectively regulated by law.With the development of economy and the progress of society,people’s quality has been continuously improved,and they have gradually realized the cruelty and anti-social nature of animal cruelty.Promoting anti-animal cruelty legislation is the only way to improve this situation.At present,there are only a few laws in China that do not have corresponding standards for classification and protection of many animals,and the scope of protection is very limited.This puts animals in a gray area where there is no legal protection in the aspects of breeding,transportation,and utilization.Therefore,there are often incidents of cruel treatment of animals.In addition to the standard division of animal needs,we also need to clarify the legal responsibilities for cruelty to animals.Based on the national conditions of our country,this article discusses the relevant issues of anti-animal cruelty legislation suitable for our national conditions in accordance with the thinking of raising problems,analyzing problems and solving problems.In addition to the introduction and conclusion,the thesis is divided into five parts.The first part is the current situation of domestic anti-animal cruelty.Starting from the social reality of domestic animal cruelty,it pointed out the deficiencies of the current laws and regulations,as well as the "Anti-Animal Cruelty Law" expert suggestions and disputes.The second part analyzes the problems faced by anti-animal cruelty legislation.In view of the problems encountered in reality,the analysis was carried out from three aspects: lack of legal basis,no standard for "abuse",and unclear definition of the scope of animal protection.The third part discusses the necessity and feasibility of anti-animal cruelty legislation.The fourth part is the reference of foreign anti-animal cruelty legislation.Through the introduction to the animal protection regulations of the United Kingdom,the United States and European countries,we are looking for experience that can be used for reference.The fifth part puts forward the proposal of enacting the legislation of our country’s anti-animal cruelty law.Put forward clearly define the concept of abuse,improve the classification standards of animals,formulate different anti-abuse protection measures for different types of animals,play the role of anti-animal cruelty organizations,stipulate that animal cruelists should bear corresponding legal responsibilities and combine anti-animal cruelty Propaganda and other six aspects of the proposal are based on a sound legislation.In short,anti-animal cruelty itself is to protect animals at a minimum,and we should explore feasible strategies for advancing our country’s anti-animal cruelty legislation in light of our national conditions.Strive to change the public perception of society,improve the status quo of blank legislation,and contribute to the harmonious coexistence of humans and animals and the establishment of a good international image of my country.
