| The novel coronavirus pneumonia animal epidemic outbreak once again focuses on the topic of overeating wild animal,and the public opinion on wildlife protection legislation has not yet subsided.Due to human beings’ endless squeezing and plundering of animal habitats,excessive eating and catching of wild animals and the formation of the corresponding industrial chain,not only lead to the reduction of the number of wild animals,but also leave a huge hidden danger for major public health events.It is an urgent task to strengthen the legislation of wildlife protection and build a perfect legal system of wildlife protection in the post epidemic era.In this paper,by combing the status quo of wildlife protection law and other domesticated animal protection laws in China,we further evaluate the legislation of animal protection in China.In view of the lack of China’s animal protection legal system and the problems existing in all kinds of animal protection laws,combined with China’s basic national conditions and the experience of foreign animal protection legislation,this paper explores how to improve China’s animal protection legislation,so as to draw suggestions on the construction of China’s animal protection legal system.China’s animal protection legislation needs to start from the construction of reasonable internal and external relations.From the perspective of internal structure,we need to formulate a comprehensive legislation "animal protection law" which plays a leading role in the protection of wild animals and all kinds of domesticated animals,and take it as the basic law of animal protection.At the same time,according to the different classification of wild animals,farm animals,experimental animals and other animals,targeted legislation is carried out in the form of separate protection law according to the characteristics of all kinds of animals,and administrative regulations and rules are used as supplementary and detailed means to realize the comprehensive legal regulation of animal protection,so as to regulate the relationship between human and animals.From the perspective of external relations,the legal system of animal protection needs to achieve a reasonable connection with civil law,criminal law,administrative law and other legal norms.Finally,the animal protection legal system with reasonable internal logic and complete system will be established. |
