With the development of Internet plus,new business models emerge as the times require.The innovation and development of business models have promoted the new form of labor employment,namely "Internet platform + personal".These forms are mainly reflected in the platform self support mode,new sharing mode,multiple mixed mode,etc.These new forms of labor employment have undergone new changes in labor subjects,labor forms and labor relations,and the mobility and flexibility of workers are higher.However,compared with the traditional labor relations,it is more difficult to identify the labor relations between workers and employment platform in the new form of employment.At present,the Internet platform economy has become the general trend of social development,the labor disputes between the network employment platform and workers are increasing,and most of the disputes focus on whether the labor relationship is established between the employment platform and workers.The traditional standards and methods of labor relations identification can not adapt to the characteristics of the network platform employment,and can not objectively and accurately judge the labor legal relationship between the employment platform and workers under the new labor mode.It is urgent to protect the legitimate rights and interests of this part of the network contract which is not clearly included in the scope of workers.Based on this,this paper analyzes the development of the new labor mode in China,combined with the experience of judicial practice in China and the theoretical theory of scholars,and discusses the legislative and judicial experience and theoretical experience of foreign countries.Thus,we put forward specific suggestions for the development direction of the standard of labor relations in China:the labor relations under the background of "Internet plus" should be properly adjusted to the scope of the main body of labor;we should accurately identify the subordinate relationship between the employment subject and the laborers in labor relations,and we should accurately identify the paid labor of laborers.On this basis,other reasonable factors and objective conditions are comprehensively considered,so as to standardize the identification standard of new labor relations under the Internet economy.We should inherit the beneficial factors of the traditional labor relations identification standard and make up for the deficiency of its identification standard in the context of the "Internet plus" standard of labor relations,and expand it based on learning and drawing on the mature experience of other countries,so as to make this standard more scientific and accurate.
