Research On The Licensing Mode Of Digital Music Copyright

The rapid development of digital network technology has profoundly changed the communication form of music works and the business model of music industry.At present,the real record industry has shown a declining trend.Online demand and download of music on the network music platform has become the main way for people to enjoy music works.In the era of digital music,what kind of copyright licensing mode should be constructed to effectively deal with the problem of large-scale licensing of music works,safeguard the legitimate rights and interests of music copyright owners,and coordinate the conflict between the licensing efficiency and communication efficiency of music works,which is related to the interests of music copyright owners,recording producers,network music service providers,and the health of China’s music industry development and smooth transformation.Therefore,this paper proposes that the design of digital music copyright licensing mode should adhere to the spirit of balancing the interests of multiple subjects,fully consider the interests of all parties and differences in business models,and respect the pursuit of music copyright owners for the efficiency of work licensing and the insistence of network music service providers for maximizing the efficiency of work dissemination.As for the exclusive licensing mode of digital music,which is widely used in practice,it should not be rashly prohibited.The correct way is to make necessary restrictions on it,optimize the system design,and play a affirmative role in facilitating the legalization of the digital music market.The large-scale licensing of digital music works needs the help of transparent and efficient music copyright collective management organizations.In terms of the excessive administration of copyright collective management organizations and the inherent monopoly problems in China,we should break the legal monopoly pattern,introduce market licensing subjects and build a multi copyright centralized licensing contract system to solve them.We should timely build the legal license mode for music works under the digital network environment,and improve the relevant supporting guarantee systems,so as to efficiently protect the lawful rights and interests of music copyright owners and enhance the operability of the legal license mode.
