Research On The Legal System Of Correctional Education For Juveniles Serious Juvenile Misbehavious

All kinds of bad behaviors in the growth process of minors have been paid wide attention,especially the illegal and criminal behaviors of minors are the focus of society,an endless series of juvenile criminal cases,while winning the attention of the masses,also attract people to think about how to effectively prevent juvenile crimes?What should minors do after bad behavior and illegal and criminal behavior? In view of the current situation of juvenile delinquency,our country in the prevention of juvenile delinquency,also implemented the illegal minors correction education,China in the early days of the founding of new China established specialized minors correction organs,in years of practice successful education,corrected a large number of criminal minors,explored many effective education correction methods.However,compared with the actual needs of minors who commit crimes in China and the correction system of foreign minors,the education and correction system of minors in China is not perfect,the quality of correction is not very satisfactory,and some minors’ the rate of illegal crime is very high.The new Law on the Prevention of Juvenile Delinquency has introduced the classification of the minor’s fault behavior into bad behavior and serious bad behavior,which has injected new elements into the minor’s correction and education work.Also attracted the author to start to study this new topic.Based on the general problems in the process of minors’ growth and the current social development background,combined with the real cases of practical work at the grass-roots level and the data collected,this thesis analyzes the causes of serious bad behavior of minors.This thesis expounds the necessity of a new legal system of correction education.In order to better carry out the legal system of correction education for serious misconduct of minors,the author draws lessons from the advantages of Germany,Japan and Australia,and finally puts forward four suggestions to perfect the supporting laws and regulations,activate the nursing system,explore the decision procedure of introducing judicial special correction education,and implement the legal supervision through the whole process of correction education,in order to perfect the correction education system of serious misconduct of minors in our country.
