Internationalization Construction Of China International Commercial Court

In the establishment of the global rise of the tide of international commercial court of China in response to the commercial activities of the "area" all the way from commercial dispute "growth",also in order to improve the specialization level of the multinational commercial trial,and strengthen the competitive power of the domestic jurisdiction of international influence and,in 2018,respectively,in shenzhen,xi ’an China international commercial court is established.Although the construction of China International Commercial Court has achieved initial results,its degree of internationalization is still insufficient.Specifically including:the diversified dispute settlement mechanism subject international lack,the nationality of talent is single,the jurisdiction is too narrow,the litigation procedure is cumbersome,the implementation outside the region is difficult,and so on.As for the parties,the internationalization of the International Commercial Tribunal is an important indicator for them to consider when they choose the International Commercial Tribunal for dispute settlement.Therefore,this paper,based on the classification of the relevant Settings of advanced international commercial courts,starting from the actual situation in China and combining with the concept of international judicial service,provides some ideas and views on the internationalization of China’s international commercial courts.Firstly,it is necessary to enrich the international nature of the main body of the dispute settlement mechanism and appropriately introduce talents from outside the region.Second,expand jurisdiction to increase the possibility of accepting more cases;Thirdly,promote the construction of information platform,establish flexible and elastic litigation procedures to enhance the appeal to the parties;Finally,the cross-border enforcement mechanism should be innovated and the signing of international conventions and mutual aid treaties should be promoted to make the enforcement more efficient.In addition,we should carry forward the advantages of the free trade zone and take " Early and Pilot Implementation " for some major innovations or reforms,so as to reduce risks and accumulate experience for the construction of international commercial courts.The internationalization of China International Commercial Court should focus on the concept of judicial service,pay attention to the wishes of the parties and give them more freedom of choice,and pursue efficient and unique ways of dispute settlement.However,in the process of promoting internationalization,we should not make rash progress.We should combine with our own characteristics and make gradual plans to achieve a targeted goal.
