| The social insurance law refers to the sum of legal norms that adjust the relationship of rights and obligations in various social insurance relationships,and it is also an important part of the social security law.With the emergence of new economic forms in the information technology era,the sharing economy model has continued to develop.In this context,the issue of improving the social insurance system for employees in the sharing economy has become a research hotspot in the social security law,and it is also the focus of strengthening the labor rights protection of this emerging employment group.At present,my country’s social insurance law has not yet stipulated the participation of employees in the sharing economy in social insurance for employees.For flexible employees,it only opens up channels in the fields of basic pension and medical insurance.In response to the need for employees in the sharing economy to be included in the scope of the social insurance system as soon as possible,it is necessary to further improve their access to insurance,and to build an employee injury insurance system for employees in the sharing economy who cannot be included in the social insurance of employees in reality.Therefore,from the perspective of labor law,this article starts from the analysis of the legal status of employees in the sharing economy,aside from the previous "one or the other" labor relationship identification path,and categorizes it according to its subordination characteristics.At the same time,combined with the current development status of social security for employees in the sharing economy in my country,summing up and drawing on the beneficial experience at home and abroad,and putting forward the difficulties of including employees in the sharing economy in the scope of the social insurance system,for the construction of a new multi-level and typified social insurance system Improve suggestions to promote my country’s social insurance system to be more adapted to the development direction of the sharing economy,in order to benefit future legislation and actual judicial practice,and to implement social security for employees in the sharing economy. |
