Research On Criminal Regulation Of Illegal Acts In Live Broadcast

In recent years,with the continuous popularity of webcast,various forms of cyber crime continues to appear one after another.At the same time,the emergence of cyber crimes has brought challenges to many aspects of traditional criminal law theory,the lag of traditional criminal law provisions is becoming more and more obvious,which makes lots of criminals choose to commit crimes when faced with the great interests of pornography crime.In 2016,webcast developed rapidly and occupied the market,which has become a new social tool.Meanwhile,with the development of live webcast,Legal regulation problems and new forms of crime have also arisen.Illegal or even criminal acts in the process of network broadcasting have made great damage on the development of market economy and the stability of social public order,it has caused obstacles to the construction of national information industry and the healthy development of Internet industry.The root cause of the serious social harm of illegal live broadcast on the Internet is that the legal relationship involved is more complicated and the scope of dissemination is wider.Many criminal law scholars believe that punishment should be strengthened,and relevant provisions of the criminal law should be supplemented and improved in the face of criminal acts such as obscene and pornographic live broadcasts.This article,which divided into four parts,discusses the regulation of illegal acts of live webcast from the perspective of criminal law.The first part is an overview of webcast,introducing the concept,main features and development status of live broadcasting;then it analyzes the necessity of criminal regulations for illegal activities in live webcast.The third part discusses the main problems existing in the regulation of the current criminal law in the network illegal live broadcasting,including the dispute on the application of crimes and the inconsistency of judicial standards.The last part puts forward some perfect suggestions on the regulation of illegal activities in network broadcasting.Therefore,it is necessary to intensify efforts to crack down on illegal and criminal acts of network live broadcasting,strengthen supervision over the field of network live broadcasting,and ensure the safe and healthy development of network live broadcasting industry.
