The Judicial Path Of Legalization Of China’s Network Governance

With the rapid development of the Internet,tremendous changes have taken place in people’s lives.Meanwhile,Internet infringement has become increasingly obvious.At present,China’s legislation on the Internet is not perfect and the network order is not standardized,which leads to the frequent infringement of citizens’ private rights in the Internet field.Under this background,the court to promote the justice studies of network governance under the rule of law in our country,through the trial of the Internet infringement cases,gradually improve the system of Internet judicial judgment,that is to say Internet court set up to promote the network governance under the rule of law,for the maintenance of order of the Internet in our country under the rule of law has played a very key role,and helps to regulate the illegal action of the Internet.This paper is mainly divided into four parts to conduct judicial research on the legalization of network governance in China:The first part is a basic overview of the legalization of network governance.This paper mainly analyzes the concept and foundation of the legalization of network governance.To explore the challenges of network governance to private rights in the Internet era.The second part is the discussion of the judicial path of network governance.It is clear that the basis for the establishment of Internet courts is the legalization of network governance.On this basis,the development process of relevant Internet courts at home and abroad is further sorted out to clarify the important value of Internet courts for network governance.The third part is the key content of this paper,the case trial of China’s Internet court empirical analysis.Case database-Alpha database via the Internet,in China Beijing,Hangzhou and Guangzhou,the number of the Internet in the trial court,trial type,trial quantities,and the deadline is analyzed,and sums up the general conclusion,for the Internet court law specialized talented person’s raise,the direction of the trial,trial efficiency improve both the status analysis and improvement direction.The fourth part discusses the development dilemma of the current Internet court in China and puts forward relevant Suggestions for improvement.The Internet court has a lower threshold for prosecution,a faster speed and a faster pace.However,due to the high proportion of cases withdrawn,it should also avoid the waste of judicial resources in the actual process of subsequent trials.According to the above analysis results,combined with the current reality,this study provides improvement directions and Suggestions for the development of the Internet court and the network legalization process in China.
