Research On The Identification And Use Of Informers From The Perspective Of Criminal Practice

In the highly developed science and technology era,more and more advanced technologies are used by criminals to commit crimes,which poses more severe challenges to police investigation methods and more stringent requirements for police evidence collection.Using informants to detect cases has always been a national police machine all over the world.Important means.However,in reality,informants are not only the right assistants of the police in criminal investigation,but also the offenders.These two identities conflict with each other,resulting in many problems in the use of informants.Therefore,we should improve the establishment system of informers and put it under the rule of law.On the one hand,we should protect the informant’s activities under the legal norms,on the other hand,we should restrict informers’ use of the rules to infringe on the legitimate rights and interests of ordinary citizens and even commit crimes and evade attacks.Compared with the normative and perfect informant system in developed countries or regions,the regulations on informants in our country are rather general and principles,which can not adapt to the increasingly complex situation.The purpose of this paper is to analyze and study the system of informant and informant,combine the advanced system of developed countries and their own practical experience,and put forward some suggestions in view of the deficiencies of our informant system,so as to combat crime and safeguard the legitimacy of the people under the vision of the rule of law in our informant system.Right.This paper is divided into five parts.Among them,the first part is the introduction,which elaborates the background of the times of the use of informants in China,and analyses the identification and use of informants from the perspective of domestic criminal law;The second part,"Overview of Informers and Status of Identification",explains the concepts,classification,and characteristics of the informants studied in this article,the history of informants,and the status of use of informants in criminal investigations;The third part,"The problems in the identification and use of informants in China",summarizes the problems existing in the legislation,application of law and criminal practice of informants in China;The fourth part is the general situation of informants system in other countries,and the informants system in the United States,Britain and Germany is analyzed and studied.The fifth part is the relevant suggestions to improve the informants system in China.This paper puts forward relevant suggestions in these aspects:further strengthening the legislative work of informants,standardizing the management and use procedures of informants,improving the relief and security work of informants,and clarifying the relevant issues in the identification and use of informants.
