Research On Copyright Protection In Self-media Environment

In recent years,with the development and popularization of self-media,the problem of copyright protection has become more and more prominent.Many new forms of infringement have appeared in the field of self-media.Reasonable use and statutory licensing systems are lagging behind.The existing legislation,laws and administrative management are not perfect.Individual rights protection is affected by subjective and objective factors.In addition,the lack of responsibilities of Internet platforms makes creators face multiple challenges.The problem of rights protection has made it difficult to protect the copyrights of self-media.From the perspective of legal regulation,the existing "Copyright Law" has gaps in the regulation of new types of infringements such as copying infringement,improper reprinting infringement,and "washing" infringement in the media.The fair use system and statutory licensing system cannot effectively balance the network environment.The contradiction between personal interests and social interests;from an administrative point of view,the copyright collective management organization under the administrative model is underrepresented,with low efficiency and insufficient transparency,and its role in resolving copyright infringement disputes under the self-media environment is limited From the perspective of the Internet platform,the self-media operators that have been in an absolute dominant position,out of the pursuit of profit,use the principle of safe haven as a shield,neglect to perform the obligation to maintain copyright,neglect the protection measures of promoting the platform,and maintain the copyright of their works.The role is limited;from the user’s point of view,creators’ rights protection are subject to subjective and objective factors,their own copyright awareness is weak,and problems such as difficulty in determining the subject of infringement in infringement disputes from media platforms,difficulty in collecting evidence,and high costs of rights protection and low benefits are common.In response to the above-mentioned problems,this article takes the diversified,high-efficiency and low-cost resolution of self-media copyright disputes as the starting point,from improving legislation,individual creators to enhance copyright awareness,strengthening Internet platform responsibilities,building extended collective management organizations,building online dispute resolution for judicial litigation,The introduction of non-litigation online dispute resolution mechanism and other dimensions put forward some thoughts on strengthening the construction of copyright protection system.
