| The self-media industry has not developed for a long time.In just ten years,from blogs to Weibo,to We Chat public accounts,Douyin and other diversified self-media platforms,it has demonstrated the vigor and vitality that other industries can’t match.Attracted a large number of practitioners in a short period of time.The rapid expansion of this volume has brought about the rapid development of the industry,but also brought many problems,such as inadequate supervision and serious infringements.With the further development of big data technology,manuscript washing,a new infringement in the Internet age,has gradually developed into a phenomenon that affects the healthy development of the industry.Manuscript washing is an academic topic that has emerged in the past two years.For the time being,there is no systematic and complete understanding and Research on manuscript washing in the field of Journalism and communication,and there is no consensus in other related academic fields.Based on the collation,induction and analysis of the collected cases,the author divides the we media manuscript washing into expression factor type and thought factor type,and thinks that this behavior has four characteristics: controversial,high object value,concealment and pseudo originality,which has a negative impact on the original author,industry order and even the network content ecology.Based on the analysis of the basic situation of we media and manuscript washing behavior,after reading a large number of relevant legal documents such as copyright law,the author defines the concept of manuscript washing behavior from the perspective of copyright law at the legal level,and distinguishes the manuscript washing behavior from the existing copyright infringement behavior in the existing legal system.Manuscript washing problem put forward corresponding proposals on how to governance,inseparable from the analysis of the cause of the problem the author from two aspects of external cause and internal cause combing and analysis on the causes of the draft,say a lack of relevant laws and regulations legislation and law enforcement on the washing draft and practical difficulties are caused by the flood of external cause,since the media platform of business logic from the media practitioners driven by interests,and the media users control the lack of consciousness of people is internal cause of the draft.In view of the causes of the draft washing,the author puts forward some feasible rectification suggestions from three aspects: system guarantee,internal and external supervision and technical support.On the system level,we should strengthen the legislative guarantee,provide ore diversified judicial identification methods,and open and report system.On the supervision level,we should make internal supervision and third-party supervision parallel,and at the same time,we should provide technical support such as large database,so as to improve the quality of governance of the chaos of manuscript washing. |
