Research On Regulation Of Personal Information Collection And Utilization In Public Health Emergencies

While China is studying how to strengthen and improve the protection of personal information in the era of big data,a sudden epidemic of the century has brought unprecedented challenges to the country’s social governance system and response measures.The practice of fighting the epidemic so far shows that China has made great achievements in the initial stage of fighting the epidemic.Compared to the most basic human rights of the people,such as health and life,other rights can be transferred or relinquished.The awareness of the country and the people have such awareness and cognition,which is an important basis for our success.Among them,developed means and mechanisms of personal information collection,integration and utilization are the key to timely finding,isolating and tracking confirmed and suspected cases as well as close contacts and blocking the chain of infection.Needless to say,the collection,integration and utilization of citizens’ personal information by various means is undoubtedly a powerful justification for the prevention and control of the spread of infectious diseases.However,to sum up and reflect,even in the context of public health emergencies,there is still the problem of protecting personal information.This paper will closely combine the practice of fighting the epidemic in China,observe and study the specific practices of personal information collection,integration and utilization,and hope to propose a good combination of legitimacy and legitimacy for the collection,integration and utilization of personal information under the background of public health emergencies.This paper firstly defines and distinguishes the relevant concepts,and at the same time distinguishes the specific meanings of the concepts in different legal provisions,so as to sort out the legal texts.Secondly,it analyzes the role of personal information collection in the disposal of public health emergencies from five aspects: subject,content,utilization,publication and storage.Thirdly,combining with relevant theories of administrative law,this paper focuses on the particularity of personal information regulation in public health emergencies from the perspective of principles.Then the legislative path is put forward,and the optimal solution is finally determined by comparing the advantages and disadvantages of multiple paths.Finally,specific applicable standards are proposed for the collection and utilization of personal information in such incidents.
