| In recent years,with the rapid development of the Internet and digital technology,an emerging industry — — live streaming of online games,has also become an important direction of the development of online culture,which generating huge market economic benefits.Live streaming of online games is a kind of live broadcast with games as the main communication content through game live broadcast platform.A series of copyright disputes have followed,which included unauthorized live streaming of online games and stealing others’ live broadcasting screens with the vigorous development of live streaming of online games industry.Nevertheless,courts lack a unified judgment criteria when dealing with copyright disputes of live streaming of online games due to the lag and limitation of legislation so that the situation of same case with different judgment exist to the same question.The copyright of live streaming of online games needs to be sorted out and clarified.Strengthening the research on the copyright of live streaming of online games is of great importance to the sustainable and healthy development of the whole industry.This thesis adopts case analysis,comparative study and other methods.First and foremost,this thesis expounds the relationship between online game screen and online game live online game based on the analysis of live streaming of online games and the connotation of the screens of online game and live streaming of online games.Besides,this thesis points out that dilemmas of copyright protection for live streaming of online games in China,which include controversial copyright attribute of live streaming of online games,the unclear ownership of the rights of the live streaming of online games screen,the disunified standard of reasonable use of the live streaming of online games screen behavior and the inadequate supervision of the online game live streaming industry through sorting out the current situations of legislation,judicial and industry autonomy in China.And then,this thesis summing up and drawing on the protection experience of typical countries through the incarnation of experience in copyright protection of live streaming from the United States,United Kingdom and Korea.Last but not the least,this thesis puts forward the thorough suggestions of clarifing the attribute and the ownership of copyright of live streaming of online games screens,identifying accurately the reasonable use of live streaming of online games and strengthening the online game live streaming industry autonomy to promote the healthy development of China’s online game live streaming industry. |
