In recent years,the online game live streaming industry has developed from a embryonic stage to a mature market in a short period of time.While its rapid development has driven the prosperity of other related industries,enriched the people’s leisure life,and greatly enhanced China’s cultural soft power.However,at the same time,many urgent problems in the field of copyright have also emerged.In recent years,although there have been few infringement cases in the online game live streaming industry,each case has great influence and there is a situation of "different judgments for the same case".Due to the lack of accurate positioning of the copyright of game live streaming images in China’s Copyright Law,there is uncertainty regarding the legal nature,ownership,and protection of rights of game live streaming images,These uncertainties pose a huge challenge to the copyright protection of the online game live streaming industry.By reviewing relevant cases in the game live streaming industry,the following issues have been identified: firstly,the legal nature of game live streaming images is unclear;Secondly,there is controversy over the ownership of the works in the live game footage;Finally,the protected mode of the live game screen is not clear.There is currently no consensus in the academic and judicial circles on these core issues.The uncertainty of the legal nature and type of live streaming images can hinder the exercise of rights by rights holders,while the ownership and protection of works affect the numerous and complex live streaming industry.Therefore,addressing these core issues not only protects the latest intellectual achievements,but also benefits the healthy development of the live streaming industry.For the appeal issue,the following aspects will be explored: firstly,not all online game live streaming images can become works,only specific types of game live streaming images that comply with the "three elements" of the Copyright Law can become works;Secondly,in terms of artwork attribution,the final attribution of the screen is determined based on the original contributions of different subjects in the game live broadcast;Finally,by drawing on the experience of protecting other online works at home and abroad,practical and feasible suggestions are proposed for the copyright protection of online game live streaming in China in the future from legislative,judicial,and industry regulations.
