Normative Study On The Exercise Of Traffic Police Power

By the end of 2019,the number of civilian cars in China had reached 261.5 million,an increase of 21.22 million over the previous year.With the rapid increase of the number of civilian cars in China,the contradiction in urban road traffic management is increasingly prominent.In order to improve the function of urban public transport,the traffic police,as the first person in charge of traffic management,shoulder the mission and responsibility,which is particularly important.In particular,whether the first-line traffic police at the grass-roots level exercise the law enforcement power or not is directly related to the vital interests of each traffic participant and the social harmony and stability.I work for a long time in traffic management frontline positions,found in the process of law enforcement,traffic police powers to exercise anomie is widespread,and regulating the traffic police power exercise,helps to protect the legal rights of the traffic participants,improve the public security organ law enforcement credibility,to maintain road traffic order,promote the harmonious development of society has a long-term significance.Taking xuzhou city traffic police power anomie performance as a case for empirical research,by analyzing a complaint reporting data,analysis,questionnaire survey,summed up the traffic police in law enforcement power optional,to the custody,weak supervision and unjust problems,from the and safeguards of law enforcement body,law enforcement,legal protection and supervision and restriction mechanism four aspects has carried on the reason analysis.After that,the author puts forward some Suggestions and measures for standardizing the exercise of traffic police power,including: improving the comprehensive level of law enforcement subjects,improving the legal guarantee system,constructing a scientific and efficient supervision and restriction mechanism,strengthening the resources and law enforcement security.While promoting the standardization of the exercise of the traffic police power in xuzhou city,it also provides a model for the standardization of the exercise of the traffic police power in other areas,which is conducive to the construction of the road traffic environment under the rule of law.
