Research On Repatriation System Within Administrative Law

In the recent few decades,as the deep acceleration of China’s opening-up,a large number of foreigners have come to China for stay and residence,which increased the pressure of country’s immigration management.The disposition of illegal aliens is the key and difficult point of China’s immigration management.Repatriation is the main way to dispose illegal aliens problem in China and a special administrative method only applicable to alien.Although the current repatriation system in China has been basically established,there are still many deficiencies,which cannot meet the practical needs of the current situation.More standardized and scientific solutions need to be put forward to settle the problem.First,start with the research background,significance,ideas,methods,status,difficulties and innovations of the repatriation system,this paper studies the basic theory of the repatriation system,and clarifies the connotation,nature and legal basis of the repatriation system.Secondly,this paper sorts out the legislative status and practical status of repatriation system.On the basis of those,the author explores and analyzes the problems in China’s repatriation system,including imperfect legislation and non-standard enforce of law.At the same time,this paper selects the repatriation systems of three typical immigrant countries to analyze and refer to the highlights and useful experiences.Finally,based on the analysis and reflection,some proposals have been put forward through this paper,such as clarifying the basic principles of repatriation,promoting the systematic construction of repatriation system,and establishing specialized repatriation system,in view of the problems existing in China’s repatriation system and the current operation status of the system.The author believes that Chinese repatriation system should clarify the principles of legality,appropriateness,relief,and reciprocity,accelerate the standardization of the repatriation system and law enforcement,establish and improve specialized repatriation department,so as to further enhance the legal level of China’s repatriation system.
