Research On The Chinese Legal System Of Repatriation Of Illegal Immigrants

From July 1,2013 China on the implementation of Exit and Entry Administration Law in chapter 6 of the survey and return,which is the core of the legal system of illegal immigrants repatriation,develops the legal system of our country.This paper clearly presents illegal immigrants repatriation on the basis of the related definition and connotation,sorts out the theoretical foundation of the legal system and legal basis,discusses the current situation of the Chinese illegal immigrants and the main content of the legal repatriation system and deeply analyzes the attractiveness and shortcoming of the system,it is concluded that the legal repatriation system have made progress,there are still some defects,for example: part of legal language is not standard and the law is not clear;measures to limit activity have defects;relief procedure is not perfect;law enforcement lack the ability to handle cases;illegal immigrants' human rights protection needs to be strengthened.Reference to traditional immigrant country the United States and the traditional nation Germany's illegal immigrants repatriation of their successful experience of the legal system,we combine them with actual situation existing in our country,put forward from the refined the related laws and regulations,increase the penalties for illegal immigration,illegal residence and illegal employment,improve the repatriation of the rights of relief procedures,improve the grass-roots organization's ability to manage illegal immigration and actively explore the international cooperation to perfect our legal system of illegal immigrants repatriation.
