Research On The Characteristics And Discovery Mechanism Of Organized And Gang Crimes

Organized and gang crime is an organized criminal activity that seriously endangers social order,economic development and the normal production and life of the masses,it seriously threatens the security of state power,the stability of social operation and the safety of people’s lives and property.At the 2022 Central Conference on political and legal work,it was stated that "we will carry out the campaign to eliminate the evils of organized crime on a regular basis and focus our efforts on solving the prominent problems that affect the people’s sense of security." This clearly called for the improvement and improvement of the working mechanism for making the work of eliminating the evils of organized crime a regular practice,crack down on key industries and key areas of black and evil crimes,and make persistent and long-lasting contributions.According to the three-year special struggle experience,it is difficult and important to find out the criminal activities or clues of the underworld force.Article twenty-four of the law of the People’s Republic of China on combating organized crime stipulates that "the Public Security Bureau shall,in accordance with law,make use of modern information technology,establish a mechanism for collecting and adjudicating clues of organized crime,and dispose of them in a hierarchical and classified manner",it is clearly required to establish a mechanism for the active detection of mafia-style crimes to prevent and curb the criminal activities of the mafia-style gangs from the source.However,at present,there are some problems in the active discovery mechanism of the mafia-like forces in our country,such as unclear elements of crime discovery,lack of the mode of generation of elements of crime,insufficient application of the mechanism of crime discovery,etc.,this study intends to explore the active discovery mechanism of mafia-style crimes,and quantitatively analyze the organizational characteristics,economic characteristics,behavior characteristics and harmfulness characteristics of mafia-style crimes,this paper constructs the three-level index mechanism of the crime elements,and puts forward the theoretical framework and methods of constructing the detection mechanism of mafia-style crime through the index assignment and calculation.The full text is divided into four parts.In the first part,according to the criminal law of the People’s Republic of China and the law of the People’s Republic of China on the fight against organized crime,the legal concept and legal characteristics of the mafia are defined,the common characteristics and differences between the underworld organizations and the evil forces are summarized.In the second part,based on the legal characteristics of the Mafia,the author analyzes the cases,clarifies the relationship between the characteristic elements and the legal provisions,and summarizes the mode of the Mafia crime.In the third part,in order to verify the influence of the different characteristics and elements of the mafia on the generation of the Mafia,according to the legal characteristics of the Mafia and the characteristic elements of the mafia,this paper constructs a three-level index system which influences the generation of the Mafia,and invites the experts who have the experience of the Public Security Bureau to evaluate and calculate the weight of the index.The fourth part,based on the characteristics,elements and index system of the underworld force,puts forward the theoretical framework and methods of constructing the mechanism of the underworld force crime discovery,it provides a valuable reference for the establishment of the entity system and platform of the mafia-style criminal detection mechanism..
