Research On The Improvement Of The Legal System Of Internet Financial Supervision

Under the mode of "Internet" + "Finance",the Internet finance industry is faced with the superposition of double or even multiple risks,and the technical risks and network security risks of the Internet itself,financial credit risks,liquidity risks and system risks will all be more significant in the Internet finance.On this basis,whether the government should supervise Internet finance,how to grasp the "degree" of financial innovation and supervision,and whether the supervision mode matching with the financial system reform and the legal system can meet the requirements of future industry development are all very important,which is related to the overall economic situation of China’s financial industry development.At present,the problems of legal supervision of Internet finance in China are mainly manifested as the existing supervision mode is difficult to meet the needs of real development,the balance between legal supervision and financial innovation is difficult,and the legal norms in some fields are imperfect and absent.Overseas,the representative Internet finance development paths and legal regulation experiences of the United Kingdom,the United States and Japan are selected,and some suggestions are put forward in combination with the practical problems in China’s Internet finance development.Mainly,China’s Internet financial supervision should gradually change from separate supervision to mixed supervision,and from institutional supervision to functional supervision;Balance Internet financial supervision and innovation,and achieve prudent supervision and moderate supervision;Actively guide Internet financial institutions to form "soft laws" such as enterprise standards,industry standards and self-discipline regulations,and on this basis,upgrade the used "soft law" rules to "hard law" and other perfect paths to further promote the realization of the rule of law in the field of Internet finance.
