| The International Health regulations are the basis of the global architecture for monitoring and responding to public health risks and emergencies.Due to the unclear provision of Article 43 of the Regulation,many States parties wantonly expand their discretion and take excessive additional health measures,which has aroused extensive discussion among scholars on the implementation of additional health measures.Starting from the provision of Article 43,this paper summarizes the new developments of the implementation elements of additional health measures during the 2009H1N1 epidemic and the 2014 Ebola epidemic in West Africa,and sums up the reference function of SPS Agreement and the restrictive effect of ICCPR on additional health measures,so as to achieve an overall grasp on it.During the COVID-19 epidemic,problems still exist,such as unclear standards for the implementation of additional health measures,neglect of due diligence by States parties,weak role of the World Health Organization,and weakening international cooperation.In this regard,we should refine substantive and procedural standards of the implementation of additional health measures,promote States parties to fully implement their treaty obligations,give full play to the leading role of the World Health Organization in global public health governance and the role of monitoring the implementation of additional health measures,and deepen international cooperation between States parties,and between the World Health Organization and States parties.It has become a reasonable solution to improve the implementation of additional health measures under the International Health regulations and to realize the global response to public health risks. |
