| With the development and progress of the economy,prepaid consumption has undergone a change from a single type to a complex type,from a new consumption pattern to a general consumption pattern.Such a transition exposes the problems existing in prepaid consumption.,the most acute contradiction lies in the protection of consumer rights and interests in prepaid consumption,because the prepaid consumption,information asymmetry and one-way risk characteristics of prepaid consumption often lead to the infringement of consumer rights in prepaid consumption.The most typical problems include: infringement of consumers’ right to security.In the context of the information age,security rights include information security in addition to property security;the use of "consumption traps" infringes upon consumers’ right to know;the overlord clause infringes upon consumers’ independent choice.right.Prepaid consumption should exist as a "win-win" consumption model,but because the operator pursues his own interests excessively and ignores the interests of consumers,it eventually leads to the imbalance of rights and obligations of both parties,which exposes many problems.Therefore,the interests of both parties should be maintained in a balanced state through the construction of a consumer rights protection system in prepaid consumption.The construction of consumer rights protection system in prepaid consumption should start from both macro and micro perspectives.The macro countermeasures mainly include: improving consumers’ rights protection ability and awareness,which is a process of internalization of rights;building credit system and corporate responsibility;improving relevant laws and regulations of prepaid consumption.Microscopic countermeasures,that is,more concrete and feasible countermeasures,mainly include: building a market access system for prepaid consumption subjects;building a sound supervision system;industry associations and other organizations provide contract model texts;strengthening the interpretation and application of the cooling-off period system. |
