Digital financial is digital technology and the traditional financial depth fusion,through digital technology to reconstruct traditional financial forms new financial services,its essence is a new generation of information technology as the core to promote the financial industry digital process,has the characteristics of pratt &whitney,efficient,convenient,and has formed a wide participation,the development of the market share of big trend.At the same time,digital finance has not changed the nature of its financial industry.The support of digital technology has added new risk factors to the financial industry,which is an incentive to cause frequent disputes in this field.In digital financial consumption activities,digital financial consumers are in a vulnerable position due to low professional quality,poor risk resistance and high risk of information disclosure.Digital financial consumption disputes have become difficulties in the judicial field due to the large number of subjects involved and the strong professionalism of the cases.It is no longer enough to adapt to the development of digital financial economy to restrict digital financial products or service providers mainly by supervision and solve digital financial consumption disputes by offline litigation.In order to safeguard the legitimate rights and interests of digital financial consumers and resolve the disputes of digital financial consumption in a timely and efficient manner,it is necessary to improve the current settlement mechanism of financial consumption disputes.In this paper,literature research method is adopted to systematically summarize and analyze the connotation characteristics and cutting-edge theories of digital finance,consumer protection,dispute resolution mechanism and other fields by reading relevant literature on dispute resolution mechanism of digital finance.Use comparative analysis method,analyze foreign advanced dispute resolution mechanism,sum up for reference experience.Using case analysis method,this paper points out the existing problems in the current dispute resolution mechanism of digital financial consumption,and points out the direction for improving the dispute resolution mechanism of digital financial consumption in China.On the basis of improving the relevant theories of digital financial consumption dispute resolution mechanism,this paper sorts out the types and characteristics of digital financial consumption disputes,analyzes the current status and difficulties of China’s current dispute resolution mechanism,and sorts out the hierarchical dispute resolution model currently formed in China.It points out that the current mechanism in China has some problems,such as the lack of legislation,the leading of litigation procedure,the lack of sound non-litigation dispute resolution mechanism and the backwardness of online dispute resolution mechanism.Through the study of the digital financial consumer complaint system in the United States,the Financial Ombudsman system in The United Kingdom and the non-litigation dispute resolution method in Japan,the successful experience in the construction of non-litigation disputes is summarized.Starting from the actual development of digital finance in China,from the perspective of litigation,reconciliation,mediation and arbitration,combining online and offline methods,aiming at fast and convenient,safe and reliable,professional and efficient,aiming at the main problems of the current mechanism,It proposes specific improvement ideas of perfecting legal protection system,perfecting financial litigation system,enriching non-litigation dispute resolution mode and broadening the application field of online dispute resolution mechanism,so as to resolve digital financial consumption disputes fairly and efficiently,and promote the inclusive and steady development of digital finance. |
