Study On The Connection Between Executions In Cases Of Producing And Selling Counterfeit Drugs

The legal regulation of production and sales of counterfeit drug cases includes the connotation of physical connection and procedural connection,and the connection between the two affects the governance effect of counterfeit drug cases.At present,laws and regulations of different ranks provide a legal basis for the connection of executions in the production and sale of counterfeit medicines.However,in terms of top-level design,there are urgent problems to be solved in the substantive and procedural aspects of the legislation regulating the connection of executions.In terms of substance,there are the problems of ambiguous amount of convictions,and it is difficult to distinguish between counterfeit and inferior drugs.In terms of procedure,there are problems of low rank of laws regulating the connection procedure of executions,imperfect provisions of procedural content,and insufficient legislative basis for supervision.On the basis of clarifying the connotation of the connection between administrative law enforcement and criminal justice,this paper combs and analyzes the legislative status quo of the connection between execution and execution of counterfeit drug cases in administrative legal norms,criminal legal norms,and legal norms related to execution connection,combined with typical cases in practice to analyze execution connection in practice.Prominent problems in substance and procedure,it is proposed to clarify the standard of the amount of criminal charges and the definition of counterfeit drugs in the aspect of physical connection.In terms of procedural connection,it is proposed to raise the legal level of regulating the connection procedure of execution and punishment,refine the content of connection procedure,and improve the legislative basis for supervision.It is expect ed to enhance the operability of execution-to-execution linkage in combating the production and sale of counterfeit medicines,and to make execution-to-execution linkage more perfect.
