Research On The Standardization Of Administrative Punishment System For Dishonesty

A gentleman should cultivate his heart,not be good at honesty.With the in-depth promotion of the construction of a society ruled by law,the lack of social credit and the imperfect repair system have increasingly become important factors affecting social development.With its strong deterrence,low administrative cost and flexible law enforcement in social credit management,dishonesty punishment has been widely favored by administrative organs,and has a significant impact on the life of administrative counterparts.Among them,the dishonesty punishment in the administrative field,as the main tool for the overall management of social integrity of the government and its working departments and an important means of social governance,to what extent is called the innovation of governance technology and to what extent constitutes the abuse of punishment,which is a problem worthy of discussion.The phased legal structure of the administrative punishment system for dishonesty includes several stages,such as the collection of credit information,the definition of credit information,the publication of credit information,the punishment and restraint of dishonesty.Scholars have put forward many theories,such as the theory of single nature,the theory of compound nature and the theory of empirical analysis of normative structure,which have reference significance for defining the administrative legal nature of dishonesty punishment.The research structure of this paper is as follows.Firstly,sort out the relevant theories and concepts.As for the administrative law basis of dishonesty punishment,it is mainly the purpose balance theory of legitimacy and effectiveness.Secondly,using the administrative process theory and the form theory of administrative behavior,this paper analyzes the process structure of "credit information collection"（credit acceptance）-"credit evaluation"（credit evaluation）-"disciplinary measures for dishonesty"（credit use）and the nature of specific disciplinary measures.Thirdly,combined with the practical dilemma of dishonest administrative punishment system,this paper makes a jurisprudential analysis of its dilemma.Finally,in view of the above problems,this paper puts forward the regulation strategies of credit information collection,credit evaluation,dishonest punishment measures and right relief at the level of administrative law,so as to make the dishonest punishment operate strictly in the track of the rule of law.
