COVID-19,which broke out in early 2020,is still spreading around the world and has had a huge impact on global economic and social development.After the outbreak of the epidemic,China promptly launched the emergency management mechanism to respond to the epidemic,and the whole country made concerted efforts to fight the epidemic and achieved a great victory,which also provided reference experience for other countries and regions in the fight against the epidemic.As a typical public health emergency,this epidemic has pushed the research on citizens’ basic rights in public health emergencies to a peak in China.Public health emergencies are highly contagious,pose complex hazards,and are difficult to manage.They have a negative impact on the personal and property safety of citizens.in order to quickly and effectively stop the spread of dangerous situation,to the greatest extent to maintain social order,the administrative organ emergency management measures must be taken to address,in the process of exercising administrative emergency power,The basic rights of citizens are bound to be restricted and curtailed accordingly.At the same time,the vulnerability of citizens’ basic rights makes them more vulnerable to the influence and infringement of other rights subjects and public authorities in public health emergencies.Therefore,we need to constantly summarize and reflect on the deficiencies in the protection of basic civil rights exposed in public health emergencies,so as to explore a more scientific path for the protection of basic civil rights under abnormal conditions.Based on this,this paper takes the COVID-19 outbreak as the perspective and entry point,with the ultimate goal of protecting citizens’ basic rights,focuses on analyzing the current situation and causes,and then puts forward corresponding suggestions for improvement.This paper is divided into five parts.The first part is the introduction,which discusses the writing background,significance,and research status at home and abroad,paving the way for the subsequent writing of the paper.The second part is an overview of public health emergencies and the basic rights of citizens.Based on the existing views and achievements,it makes a superficial discussion and defines the objects to be discussed in this paper.The third part of the paper,starting from two modules of legislation and practice,analyzes the current situation of the protection of citizens’ basic rights in public health emergencies,which serves as the basis of the reason research of the third chapter.The fourth part analyzes the causes of the deficiencies in the protection of the basic rights of citizens in public health emergencies,and studies the various reasons in the protection of the basic rights of citizens at different levels and from different perspectives.In the fifth part of the paper,according to the status quo and reasons of the above research,and strive to put forward targeted and operational suggestions for the protection of the basic rights of citizens involved in public health emergencies. |
